1. Acceptance of Terms
By using Digiworld Tech's platform (the "Service"), you agree to these terms. If you don't agree, don't use the Service. We may update these terms anytime. If we make major changes, we'll notify you. Your continued use means you accept the updated terms.
2. Who Can Use This Service
- •You must be 18 years old or older
- •You must be authorized to enter into binding contracts
- •You're responsible for all activity under your account
- •You must provide accurate account information
3. Account Security & Responsibility
You're responsible for keeping your login credentials secure. This means:
- • Use a strong, unique password
- • Don't share your login with others
- • Let us know immediately if your account is compromised
- • You're liable for all activity using your account, even if it's someone else
We can reset your password if you request it through the account recovery process. If someone else gains access to your account, notify us ASAP at info@digiworldtech.com.
4. What You Can't Do
Don't use the Service to:
- ✗Send spam: Mass unsolicited messages, phishing, or harassment
- ✗Illegal activity: Anything that violates local, state, or national laws
- ✗Fraud or deception: Misrepresenting yourself, fake listings, or scams
- ✗Malware: Distributing viruses, malware, or harmful code
- ✗Hacking: Attempting to break into our systems, reverse-engineer code, or access unauthorized data
- ✗Harassment: Threatening, bullying, or abusing other users
- ✗Intellectual property violation: Stealing our code, copying our design, or using our trademarks without permission
- ✗Bot abuse: Automating access in ways we don't allow or overloading our servers
5. Your Data & Responsibility
You own all data you upload to the Service (your property listings, responses, etc.). You're responsible for:
- • The accuracy and legality of your data
- • Complying with all laws regarding lead collection (GDPR, India's data laws, etc.)
- • Not uploading illegal, offensive, or copyrighted content
- • Getting proper consent from leads before using our Service
You grant us permission to use your data to run and improve the Service. We won't sell your data to third parties (see Privacy Policy).
6. Our Intellectual Property
All code, design, features, and content on our platform are owned by Digiworld Tech or our partners. You can't:
- • Copy our code or design
- • Reverse-engineer how our system works
- • Create derivative works based on our platform
- • Use our trademarks without permission
You have a limited license to use the Service for your business. This license is personal to you and not transferable.
7. Payment & Billing
- →Billing cycle: Monthly subscriptions renew on the same date each month
- →Payment method: You're responsible for maintaining a valid payment method. If payment fails, we'll try again. If it continues to fail, we may suspend your account
- →Cancellation: You can cancel anytime. You'll lose access at the end of your current billing cycle
- →Refunds: Monthly subscriptions are non-refundable. If you cancel mid-month, you keep access until the end of your billing period
- →Price changes: We may change pricing with 30 days' notice. Your current rate stays the same until renewal
8. Service Availability
We aim for 99% uptime, but here's the reality:
- • We may have scheduled maintenance (we'll give you 24 hours notice when possible)
- • Outages can happen due to server issues, internet problems, or third-party services
- • We're not responsible for downtime beyond our control
- • We have no obligation to provide refunds due to downtime (except extended outages caused by us)
We monitor the system 24/7 and fix issues as fast as we can. If you experience problems, email info@digiworldtech.com.
9. Limitation of Liability
In simple terms: if something goes wrong, we're not liable for massive damages. Specifically:
- • We're not liable for lost profits, lost data, or indirect damages
- • Our total liability is capped at the amount you paid us in the last 12 months
- • This doesn't apply to illegal activities or gross negligence on our part
Why? We're a startup with limited resources. We take your data seriously, but can't guarantee perfection. This protects us from bankrupt-level lawsuits for minor issues.
10. No Guarantees (Disclaimer)
We provide the Service "as is" without guarantees. This means:
- • We don't guarantee it will meet your needs
- • We don't guarantee it will be error-free
- • We don't guarantee lead conversion or business results (we try to help, but results depend on you)
- • We're not liable if WhatsApp API breaks (it's beyond our control)
Use this service at your own risk. Do your own due diligence before signing up.
11. Termination & Suspension
We can terminate or suspend your account if:
- • You violate these terms
- • You use the Service for illegal activities
- • You abuse our systems (spam, hacking attempts, etc.)
- • You don't pay your bills
- • We're legally required to
We'll try to give you notice when possible, but for serious violations (hacking, spam), we may terminate immediately. You can request your data within 30 days of termination.
12. You Protect Us
If someone sues us because of something you did with our Service (spam, fraud, copyright violation), you agree to cover our legal costs. This is called "indemnification." In other words: if your actions cause us legal trouble, you pay for it.
13. Relationship Between Us
You're an independent user of our Service, not our employee or partner. We're not responsible for your business decisions or relationships with your leads.
14. Third-Party Services
Our Service relies on third-party services like WhatsApp Business API, AWS, and Stripe. We're not responsible if these services go down or change their terms. If WhatsApp blocks your account, that's between you and Meta.
15. Disputes
If you have a dispute with us:
- • Try to resolve it informally by emailing info@digiworldtech.com
- • If that doesn't work, you can pursue legal action in courts in Bangalore, India
- • By using our Service, you agree to this jurisdiction
16. Which Laws Apply
These terms are governed by the laws of India. Any disputes will be handled in Indian courts (specifically Bangalore). If you're outside India, you still agree to this.
17. If One Rule is Invalid
If a court says one part of these terms is invalid, the rest still applies. We'll modify just that part to make it legal while keeping the spirit of the agreement.
18. Entire Agreement
These terms (plus our Privacy Policy) are the complete agreement between us. Any previous agreements are void. We can't modify these terms verbally—any changes must be in writing.
